These Terms of Service (“Terms”) govern your access to and use of the floofee website (the “Site”) and the purchase of products or services offered through the Site (collectively, the “Service”). The Site is operated by floofee, llc (“floofee,” “we,” “us,” or “our”).

By visiting the Site, creating an account, or purchasing from us, you agree to be bound by these Terms and any policies referenced here, including our Privacy Policy (together with these Terms, the “Agreement”). If you do not agree, do not use the Site.

Our store is hosted on Shopify Inc., which provides the ecommerce platform that enables us to sell products and services.

1) Eligibility, Legal Use, and Acceptance

By using the Service, you represent and warrant that:

  • You are at least the age of majority in your jurisdiction and are legally permitted to use the Service.

  • You will not use the Service for any unlawful, fraudulent, or unauthorized purpose.

  • You will comply with all applicable laws and regulations, including intellectual property laws.

We reserve the right to refuse service to anyone for any reason at any time, subject to applicable law.

2) NSFW Content, Age Confirmation, and Access Controls

The Site offers content that may be classified as Not Safe For Work (“NSFW”), including nudity, mature themes, and depictions of anthropomorphic or fictional characters.

Age and Content Access

Errors and inaccuracies

We may correct errors in descriptions, pricing, promotions, shipping charges, transit times, and availability. We may cancel orders affected by material errors.

7) Orders, Billing, and Identity Confirmation

By placing an order, you represent and warrant that:

  • You are authorized to use the payment method provided.

  • Your billing and shipping information is accurate.

  • You are not placing orders for illegal resale, fraud, or chargeback abuse.

We may refuse, cancel, or limit any order, including orders that appear to be placed by resellers or distributors, or that appear fraudulent.

If we cancel an order, we will attempt to notify you using the contact information provided.

8) Payment Processing and Chargebacks

Payments are processed by third-party payment processors (including Shopify and its payment partners, or other processors we may offer). We do not store full payment card details on our servers.

Chargebacks

If you initiate a chargeback without first contacting us to attempt resolution, we may:

  • Suspend or terminate your account and access to digital products.

  • Decline future orders.

  • Provide documentation to the payment processor to contest the chargeback.

Nothing in this section limits any rights you have under applicable law.

9) Preorders, Made-to-Order, and Production Timelines

Some items may be preorder, made-to-order, or produced in limited runs.

For these items:

  • Estimated shipping dates are estimates and may change due to manufacturing, logistics, or supplier delays.

  • We may ship items separately if an order includes products with different availability timelines.

  • If a preorder item becomes unavailable, we may offer a refund, store credit, or substitution at our discretion, subject to law and processor requirements.

10) Shipping, Delivery, Risk of Loss, and Address Issues

Shipping

  • Shipping costs and available methods are shown at checkout unless otherwise stated.

  • Delivery timelines are estimates and not guarantees.

Risk of loss

Risk of loss passes to you upon delivery to the carrier, to the extent permitted by law. If a package is lost or significantly delayed, contact us and we will review reasonable replacement or remedy options.

Address accuracy

You are responsible for providing an accurate shipping address. If a package is returned due to an incorrect address, refusal, or failed delivery attempt, we may require additional shipping payment to reship.

11) Returns, Refunds, and Cancellations

Digital products

  • All digital product sales are final.

  • No refunds, returns, or cancellations for digital goods, except where required by law.

Physical products

  • Orders may be cancellable before shipment. Once shipped, cancellations are not available.

  • If an item arrives significantly damaged or defective, contact us within 14 days of delivery with photos of the product and packaging.

  • Returns, if offered, may require an authorization and may be subject to restocking fees, condition requirements, and return shipping responsibilities.

Content dissatisfaction

We do not offer returns or refunds solely because you dislike the content, style, or subject matter of an item, to the extent permitted by law.

12) Digital Products License (Personal Use) and Restrictions

If you purchase any digital product (including PDFs, downloads, image files, digital packs, or similar digital goods), you receive a limited, non-exclusive, non-transferable, revocable license for personal use only, unless a product listing explicitly states otherwise.

Prohibited uses

You may not:

  • Share, distribute, resell, sublicense, upload publicly, or make the product available to any third party.

  • Remove watermarks, copyright notices, metadata, or ownership markings.

Enforcement

All Site content, including text, graphics, logos, layout, product photography, and design elements, is owned by floofee or licensed to us and is protected by applicable intellectual property laws.

Except as expressly allowed in writing, you may not reproduce, copy, sell, resell, exploit, or commercially use any portion of the Site or Service.

14) Fan Art, Third Party IP, and Rights Holder Requests

Some content on this site features fictional and stylized characters. Content should not be interpreted as representing real persons, real animals, or real-world species.

Fan Art and Third-Party Content
Some products on this website may feature transformative artistic interpretations of characters or settings that may be owned by its respective rights holders. These items are unofficial works and are not affiliated with, sponsored by, or endorsed by the original creators or rights holders. We do not claim ownership of third-party intellectual property and do not intend to infringe on the rights of any creator or company. These works are presented as artistic expression and, where applicable, as parody or commentary. Good faith posture

You agree to indemnify, defend, and hold harmless floofee and its owners, employees, contractors, and service providers from any claim, demand, or damages (including reasonable attorneys’ fees) arising out of:

  • Your misuse of the Service

  • Your violation of any law or third party rights

22) Suspension and Termination

We may suspend or terminate your access to the Service at any time if we believe you violated these Terms or if required to comply with law or platform requirements.

Upon termination:

  • Your right to access the Service stops immediately.

  • Digital product access may be revoked where permitted by law and consistent with your license rights.

23) Changes to the Service and Terms

We may update, change, or discontinue the Service (or any part of it) at any time.

We may also update these Terms. The “Last updated” date will reflect the latest version. Your continued use of the Site after changes constitutes acceptance of the updated Terms.

24) Severability

26) Governing Law and Venue

These Terms are governed by the laws of Virginia, USA, without regard to conflict of law principles.

You agree that any dispute arising from these Terms or the Service will be brought in the courts located in Fairfax County, Virginia, USA, unless applicable law provides otherwise.
